BOG Talent and Culture 3.5 - Employee Leave

  1. Upon application in writing, a leave eligible employee may be granted leave with pay as indicated hereinafter in this section provided the leave eligible employee is not a party to the action. Annual leave will not be charged under the provisions of this section.
    1. When, in obedience to a subpoena or direction by proper authority, a leave eligible employee appears as a witness for the Federal Government, the State of West Virginia, or a political subdivision thereof, the leave eligible employee shall be entitled to leave with pay for such duty and for such period of required absence.
    2. When a leave eligible employee serves upon a jury, or is subpoenaed in litigation, the leave eligible employee shall be entitled to leave with pay for such duty and for such period of required absence.
  2. When attendance in a court is in connection with a leave eligible employee's usual official duties, time required in going and returning shall not be considered as absence from duty.
  3. The leave eligible employee shall report to work if he/she is excused by the court before the end of his/her regular work day. Provisions for leave eligible employees who work a shift other than day shift shall be made according to institutional policy.
