Upon application in writing, a leave eligible employee may be granted leave with
pay as indicated hereinafter in this section provided the leave eligible employee
is not a party to the action. Annual leave will not be charged under the provisions
of this section.
When, in obedience to a subpoena or direction by proper authority, a leave
eligible employee appears as a witness for the Federal Government, the
State of West Virginia, or a political subdivision thereof, the leave eligible
employee shall be entitled to leave with pay for such duty and for such
period of required absence.
When a leave eligible employee serves upon a jury, or is subpoenaed in litigation,
the leave eligible employee shall be entitled to leave with pay for such
duty and for such period of required absence.
When attendance in a court is in connection with a leave eligible employee's
usual official duties, time required in going and returning shall not be considered
as absence from duty.
The leave eligible employee shall report to work if he/she is excused by the
court before the end of his/her regular work day. Provisions for leave eligible
employees who work a shift other than day shift shall be made according to
institutional policy.
