Classified Compensation

WVU employs individuals in a variety of roles to meet its missions through the academic, research, service and administrative objectives in support of the University, its students, and the people of West Virginia. These roles may be ongoing or temporary; exempt or non-exempt; faculty, classified, non-classified or academic professional in nature. These determinations are governed by the Fair Labor Standards Act and policies of our governing Board. Management of these and interpretive and application assistance are provided by the C&C staff.

As per H.B. 2542, “classified employee” means a regular full-time or regular part-time employee of an organization who:
  • Does not meet the duties test for exempt status under the provisions of the Fair Labor Standards Act
  • Was a classified employee as of January 1, 2017, unless otherwise deemed a non-classified employee pursuant to non-classified definition sections (A) through (D) below
  • Does not qualify as a non-classified employee as defined below

    Non-classified Compensation

    As per H.B. 2542, “non-classified employee” means a non-faculty regular employee of the University who meets one or more of the following criteria:

    A) Holds a direct policy-making position at the department or organization level; 
    B) Reports directly to the president or chief executive officer of the University; 
    C) Is in a position considered by the president or designee to be critical to the institution pursuant to policies or decisions adopted by the governing board; 
    D) Is in an information technology-related position;
    E) Is hired after July 1, 2017, and meets the duties test for exempt status under the provisions of the Fair Labor Standards Act at the time of hire or anytime thereafter; or
    F) Was in a non-classified position as of January 1, 2017
